European Product Design Award – Terms and Conditions

1. Parties and Legal Structure

The European Product Design Award (EPDA) is owned by Farmani Group Inc., 5101 Santa Monica Blvd, Ste 8 PMB 1192, Los Angeles, CA 90029, USA (“Farmani Group”).

EPDA is operated under license by Blue Dot Solutions Limited, 20F Euro Trade Center, 21–23 Des Voeux Road Central, Hong Kong (“Blue Dot Solutions”).

– For entrants based in Hong Kong, the contractual relationship is between the entrant and Farmani Group Inc. (USA).
– For entrants based outside Hong Kong, the contractual relationship is between the entrant and Blue Dot Solutions Limited (Hong Kong).

Both entities are hereafter referred to collectively as “EPDA,” “we,” “our,” or “us.”
All participation in the European Product Design Award (“the Award”) is governed by these Terms and Conditions.

2. Scope of Application

These Terms govern all relationships between EPDA and participants, including registration, submission, communication, payment, award evaluation, publication, and post-award use of materials.

3. Eligibility

The Award is open to professional designers, design teams, studios, companies, and students worldwide who have created products or concepts that meet EPDA’s submission criteria. EPDA reserves the right to refuse any entry that does not meet eligibility, quality, or ethical standards.

4. Registration and Formation of Contract

A contract between the entrant and EPDA is formed when the entrant completes online registration and EPDA issues written or electronic confirmation of acceptance. EPDA may reject or cancel registrations that contain incomplete or inaccurate information.

5. Entry Materials and Intellectual Property Rights

1. The entrant warrants that all materials submitted (including images, text, video, and design content) are original works and that the entrant holds all rights necessary for participation and publication.
2. The entrant grants EPDA a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, reproduce, edit, translate, publish, display, and distribute submitted materials in any media for purposes including but not limited to: jury evaluation, promotion of the Award, exhibitions, press releases, and archival reference.
3. EPDA may attribute authorship at its discretion.
4. The entrant indemnifies EPDA against all claims by third parties relating to infringement of rights.
5. EPDA may withdraw or revoke an award if plagiarism or legal infringement is discovered after results are announced.

6. Fees and Payment Terms

1. Entry and winner-package fees are due immediately upon invoicing and must be paid in full without deduction.
2. All prices are stated in EUR or USD, exclusive of VAT or equivalent taxes where applicable.
3. Payments must be made using the methods specified on the EPDA website.
4. Failure to pay within the stated deadline may result in cancellation of participation.
5. Except where legally required, fees are non-refundable once the submission period has closed or jury evaluation has commenced.

7. Withdrawal or Cancellation by Entrant

Entrants may cancel participation in writing within 14 days of registration provided the jury process has not begun. A processing fee may apply. After the start of evaluation, withdrawal does not entitle the entrant to any refund.

8. Evaluation and Jury

Entries are assessed by an independent panel of jurors appointed by EPDA. Jury deliberations are confidential and decisions are final.

9. Publication of Results

Award results, participant names, project titles, and visual materials may be published on EPDA’s website, in digital and printed media, and in partner communications.

10. Use of the EPDA Logo and Award Seal

Winners may use the EPDA logo and award seal for promotional purposes in accordance with EPDA’s brand-use guidelines. Misleading or unauthorized use is prohibited.

11. Limitation of Liability

1. EPDA will exercise reasonable care in operating the Award but shall not be liable for technical failures or loss of submitted data.
2. To the extent permitted by law, EPDA’s liability is limited to intent or gross negligence.
3. Nothing limits liability for death or personal injury resulting from negligence.

12. Data Protection

EPDA processes personal data in accordance with its Privacy Policy and applicable data-protection laws. By registering, entrants consent to such processing.

13. Force Majeure

EPDA shall not be responsible for any delay, cancellation, or modification of the Award caused by events beyond its reasonable control.

14. Amendments

EPDA reserves the right to amend these Terms and Conditions at any time. The version in effect at the time of registration shall apply.

15. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
